FOR WHAT PURPOSE WILL PERSONAL DATA BE PROCESSED, ON WHAT BASIS AND FOR HOW LONG?
Your personal data will be processed on the basis of the Administrator's legal obligation to:
- To establish your identity before providing health services,
- qualification for rehabilitation camps,
- providing rehabilitation care,
- Conducting health surveys,
- maintenance of medical records,
- regarding the provision of health information, the release of medical records, and the maintenance and storage of medical records,
- Management of the health care system and services,
- Article 9(2)(h) of the RODO, Article 6(1)(c)(a) and (f) of the RODO in connection with the regulations governing the process of providing health services, i.e.:
- Law of April 15, 2011 on medical activity,
- Act of 6.11.2008 on Patient Rights and Patient Ombudsman, as amended.
- Law of April 28, 2011 on the health care information system and other relevant national laws,
- Ordinance of the Minister of Social Policy of April 28, 2005 on the issuance and revocation of licenses for statutory activities in the operation of an institution providing 24-hour care (Journal of Laws No. 86., item 740),
- Regulation of the Minister of Health of November 6, 2013 on guaranteed services in the field of inpatient rehabilitation,
- Regulation of the Minister of Health of April 6, 2020 on types, scope and models of medical records and the manner of their processing,
- Act of 5.12.1996 on the professions of physician and dentist, as amended.
- for the storage of medical records - for a period of 20 years, counting from the end of the calendar year in which the last entry was made, with the exception of: medical records in the case of death of a patient due to bodily injury or poisoning, which is kept for a period of 30 years, counting from the end of the calendar year in which the death occurred,
- if you have not become our patient, and we have obtained your data during registration, it will be deleted up to one month from the date of enrollment,
- To provide social security including the issuance of medical certificates and exemptions,
- Article 6(1)(c) and Article 9(2)(h) of the RODO
- for a period of 20 years, counting from the end of the calendar year in which the last entry was made,
- in terms of contact through the use of a telephone number or e-mail address to cancel, change or confirm a rehabilitation camp, to inform how to prepare for a stay at the resort or about the possibility of collecting test results,

- Regulation of the Minister of Health of April 6, 2020 on types, scope and models of medical records and the manner of their processing, as amended.
- you are we have created your medical records then we are obliged to keep them for 20 years including your contact information,
- if you have not become our patient, and we have obtained your data during registration, it will be deleted up to one month from the date of enrollment,
- for the purpose of bookkeeping and tax obligations - we issue invoices for services, for example, which may involve the processing of your personal data,
- Article 6(1)(c) of the RODO in conjunction with the provisions of the Accounting Act of September 29, 1994,
- for a period of 5 years from the end of the calendar year in which the tax obligation arose,
- in order to defend the rights and assert claims of the data controller in connection with its operations,
- Article 6(1)(b) and (f) RODO,
- for the period of limitation of these claims in accordance with the provisions of the Civil Code,
- The NEUROPORT facility (lobby, passageways, entrance, parking lot) has video surveillance to enhance the safety of employees and patients, as well as to protect property located within the facility.

- data will be processed for a period of up to 90 days - exception: in the case where the image recordings constitute evidence in proceedings under the law or the employer has become aware that they may constitute evidence in the proceedings, the period of 3 months is extended until the final conclusion of the proceedings).
WHAT PERSONAL DATA DO WE PROCESS, HOW DO WE PROCESS IT, AND WHERE DO WE GET THE DATA FROM?
- The administrator processes the data you provide such as:
a) name, surname, date of birth, PESEL, gender designation, residential address, e-mail address, telephone number, health data;
(b) bank account details and details of the bank or payment institution, if patients make payments to the Administrator by payment card or bank transfer;
c) data of persons authorized to inform about the patient's health condition and to obtain the patient's medical records, i.e. name, surname, optional: address and/or telephone number, degree of relationship. Patient, please inform the persons you have authorized to inform about your health condition and to obtain your medical records that you have provided us with the person's personal and contact information. - All personal data will be processed in computer systems, and in case of failure outside computer systems in paper form. We will also process your personal data in paper form on, among other things, consents in case of surgery, authorization statements, etc. We obtain all data directly from the patient or legal guardian in case the patient is incapacitated.
- Our patients' data is not used for automated decision-making, including profiling.
TO WHOM IS PERSONAL DATA TRANSFERRED AND SHARED?
Personal data of our patients may be:
- transferred to entities that process personal data on our behalf. Such an order refers to activities supporting the provision of health services as well as activities related to the maintenance of the ICT system in which medical records are processed and ensuring the security of this system, as well as to providers of IT, technical or organizational services that enable the provision of health services - with such entities processing data on the basis of an appropriate Agreement with the Administrator and only in accordance with the Administrator's instructions,
- made available to entities authorized by law, in particular in accordance with Article 26 of the Act of November 6, 2008 on Patient Rights and Patient Ombudsman, including but not limited to medical professionals who are employed or cooperate with EJMEDICAL Sp. z o. o. or other cooperating health care providers to ensure the continuity of health care services, and to public authorities, including the Patient Ombudsman, authorities of the self-government of medical professions, CSIOZ, and national and provincial consultants, to the extent necessary for these entities to perform their tasks, in particular inspections.
We do not send our patients' personal data to countries outside the European Economic Area (EEA).
WHAT RIGHTS DO PATIENTS HAVE IN RELATION TO DATA PROTECTION?
In connection with the processing of personal data, each of our patients is entitled to:
- Access to personal data and rectification of personal data that is incorrect, completion of incomplete personal data,
- Deletion of personal data - if one of the prerequisites is met, among others, personal data is no longer necessary for the purposes for which it was collected. The right to erasure may be limited and exercised only after the mandatory period of retention of medical records due to the Administrator's obligations to maintain medical records (If we erase the data of the person making such a request, we have the right to retain information about whose request we did so. We will honor the request as soon as possible, taking into account the circumstances and our technical capabilities),
- Portability of personal data - to receive personal data in a commonly used format if the processing is carried out by automated means. You may send the data to another controller or request that the personal data be sent by the controller directly to another controller, if technically possible,
- object to the processing of personal data and file a complaint with the President of the Office for Personal Data Protection, 00-193 Warsaw, 2 Stawki Street.
IS IT NECESSARY TO PROVIDE PERSONAL INFORMATION?
- The use of our services is entirely voluntary; however, we are obliged to maintain medical records in the manner prescribed by law, including marking the identity of the patient
with the use of his/her personal data. In such a case, failure to provide data may result in the refusal of registration for rehabilitation holidays or the provision of health services offered
via NEUROPORT. - For accounting and tax reasons, we have a legal obligation to process your data, failure to provide it may result, for example, in the inability to issue an invoice for the services obtained. Providing a telephone number is done on a voluntary basis in order to be able to contact you - its absence will not result in a refusal to provide health care services.

WHERE DO WE GET THE DATA FROM?
Your personal data is provided directly by you or by your employer or the entity you represent. Your personal data may also be obtained from publicly available sources, such as the KRS register or CEIDG.
WHAT DATA DO WE PROCESS?
We process your personal data in the scope of your name, surname, telephone number, e-mail address, position, name of the represented entity and registered office of this entity. If you are acting as a representative or contractor body of Ejmedical sp. z o.o., or if you are a partner in a partnership or a sole proprietorship, Ejmedical sp. z o.o. may process your personal data in a broader scope that also includes your PESEL number and any other personal data contained in public records and within the framework of the power of attorney provided.
FOR WHAT PURPOSE AND ON WHAT BASIS DO WE PROCESS PERSONAL DATA?
Your personal data will be processed for:
- to contact us on current matters or to respond to questions or matters addressed to us (Article 6(1)(f) of the RODO, as the so-called legitimate interest of the administrator, which is to provide contact on current matters arising from Ejmedical sp. z o.o.'s business),
- To conclude and perform a contract, including as part of billing and providing ongoing business correspondence (Article 6(1)(b) RODO, i.e. to perform a contract to which the data subject is a party, or to take action at the request of the data subject prior to entering into a contract).
- in the context of asserting claims from our business activities, defending against these claims and thus processing your data for this purpose (Article 6(1)(f) of the RODO, as the so-called legitimate interest of the controller, which is to assert our claims and defend our rights).
- as part of a tax obligation including bookkeeping-we issue, for example, invoices for the services we provide, which may involve the processing of your personal data (Article 6(1)(c) RODO, i.e. fulfillment of a legal obligation incumbent on the controller (e.g. under tax law)).
- as part of the cooperation between us, we may send you information about our activities, offers or other content informing you about the possibility of cooperation with Ejmedical sp. z o. o. (Article 6(1)(f) RODO, as the so-called legitimate interest of the administrator, which is to build and maintain relations with our contractors). Your personal data will be processed for the period of execution of the concluded agreement and for the time resulting from the legal regulations in the area of accounting imposed on the Administrator, as well as the time resulting from the protection against claims.
On the premises NEUROPORT (lobby, passageways, entrance, parking lot) video surveillance is carried out in order to increase the safety of employees and patients, as well as to protect property located in the facility. Your image will be processed on the basis of Art.6(1)(f) of the RODO for a period of up to 3 months, after which the recordings are overwritten and cannot be restored (exception: in cases where the image recordings constitute evidence in proceedings under the law, or the employer has become aware that they may constitute evidence in the proceedings, the 3-month period is extended until the proceedings are legally concluded).
TO WHOM ARE PERSONAL DATA TRANSFERRED?
Your personal data may be transferred to entities cooperating with the Administrator, i.e. providers of IT systems, companies providing archiving and document destruction services, accounting and bookkeeping offices, courier and postal companies, and entities authorized to do so under separate laws. In the event of the need to assert due claims, we may make your data available to law firms and debt collection companies.
WHAT RIGHTS DO WE HAVE IN RELATION TO DATA PROTECTION?
You have the right to access the content of your personal data and the right to request: rectification, deletion (if the law does not require the storage of such data), restriction of processing. You also have the right to lodge a complaint to the supervisory authority, i.e. the President of the Office for Personal Data Protection.
IS DATA TRANSFERRED OUTSIDE THE EOG AND IS DATA USED FOR PROFILING?
- The Administrator does not transfer your personal data to countries outside the European Economic Area (EEA).
- Your personal data is not used for automated decision-making including profiling.
IS IT NECESSARY TO PROVIDE PERSONAL INFORMATION?
Your provision of personal data is done on a voluntary basis. Failure to provide data will result in our inability to conclude a contract, answer your questions, or provide other content requested by us.

FOR WHAT PURPOSE, ON WHAT BASIS AND FOR HOW LONG DO WE PROCESS PERSONAL DATA?
- Your personal data will be processed in order to carry out the recruitment process Based on the consent you have given (RODO Article 6, paragraph 1, letter a).
- Your data will be processed up to 3 months from the end of the recruitment process for the purpose of defense against possible claims, and then they will be deleted, unless you have agreed to leave the personal data contained in the application documentation for the purpose and to the extent necessary to participate in future recruitment processes, including informing about the ongoing recruitment by the Administrator then your data will be processed for up to 3 years.

or the employer became aware that they may constitute evidence in the proceedings, the 3-month period shall be extended until
final termination of the proceedings).
WHERE DO WE GET YOUR DATA FROM?
We receive your personal data directly from you in your application documents.
WHAT RANGE OF DATA DO WE PROCESS?
We process the data contained in the C.V. you submit, including your first name, last name, date of birth, place of residence (mailing address), education, previous employment history, telephone number and e-mail address. If you are a medical professional, we also collect your C.V. number. You provide us with data beyond this scope on a fully voluntary basis (e.g., image (photo), interests) and failure to provide this data has no effect on the recruitment process.
WHAT RIGHTS DO WE HAVE IN RELATION TO DATA PROTECTION?
You have the right to access the content of your personal data and the right to request: rectification, deletion (if we delete the data of the person making such a request, we have the right to retain information about whose request we did so. We will grant the request as soon as possible, taking into account the circumstances and our technical capabilities. If we are unable to separate the requesting person's data from other data that is in our systems, we may withhold the request - until we mutually agree on which data we can share), limitation of processing, the right to revoke your consent. You also have the right to file a complaint with the supervisory authority, i.e. the Office for Personal Data Protection.
TO WHOM ARE PERSONAL DATA TRANSFERRED?
Your personal data may be transferred to entities supporting the Administrator in the recruitment process, i.e. recruitment agencies, IT system providers, companies providing document shredding services, law firms and entities authorized to do so under separate laws.
IS DATA TRANSFERRED OUTSIDE THE EOG AND IS DATA USED FOR PROFILING?
